1) NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST. A purchase will not improve your chances of winning. The Maxell/Alexisonfire ("Contest") starts at 12:00:01 a.m. Eastern Time ("ET") September 12, 2006 and ends at 11:59:59 p.m. ET on December 1, 2006. The sponsor of this Contest is Maxell Canada 50 Locke Street, Unit 2, Concord ON L4K 5R4 (the "Sponsor"). The Contest shall be subject to these Official Rules and Regulations (the “Rules”) available at www.maxellcanada.com. By entering, all participants agree to be bound by the terms and conditions of the Rules.
2) ELIGIBILITY. CONTEST IS OPEN TO LEGAL RESIDENTS OF CANADA; WHO HAVE REACHED THE AGE OF 19 AS OF THE DATE OF THEIR ENTRY; except employees of Maxell, their respective advertising and promotional agencies, the independent judging organization, and members of their respective immediate families living in the same household; subject to approval from the Regie des alcools, des courses et des jeux regarding the Province of Quebec..
3) ENTRY FORM. To enter, fill out the electronic entry form available online at www.maxellcanada.com (the “Website”). Limit of one entry per person per month and/or 10 entries per household per month. Sponsor, and their respective affiliates, officers, directors, employees and agents (collectively the "Releasees") are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; congestion, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; printing; administrative or other errors of any kind or any combination thereof. Proof of entering information at the Website is not considered proof of delivery or receipt. Incomplete and duplicate entries will be disqualified. All entries become the property of the Sponsor and will not be returned. False and/or deceptive entries or acts shall render entrants ineligible. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Rules and with the Maxell’s Online Privacy Policy.
4) PRIZES. Grand Prize – There is one (1) Grand Prize to be won from all eligible entries received during the Contest Period. Grand Prize consist of a trip for two (2) to Toronto to see Alexisonfire live at a small club. Includes return airfare from the closest airport to winner’s Canadian residence to Toronto, one night accommodation for two (2), two (2) concert ticket, $500 spending money and a Maxell prize pack, approximate value of Grand Prize totals $3,000. It is the winner's and his/her guest’s responsibility to provide for any additional expenses not included in the Grand Prize as described herein, including, but not limited to, travel insurance, health insurance, meals, gratuities, in-room movies, taxis, return transportation between the winner's home and the airport. The Sponsor assumes no responsibility should the Grand Prize winner and his/her guest be denied airline entry for any reason whatsoever. Secondary Prizes – There are 20 Secondary Prizes to be won from all eligible entries. A Secondary Prize consists of one (1) of twenty (20) Alexisonfire limited edition Maxell USB Flash Drives loaded with behind the scenes video clips, live concert footage and a new Alexisonfire single, approximate retail value of $50.00. At time of draw, if any prize is not available for any reason, Maxell reserves the right to substitute a Secondary Prizes with an item of equal or greater value.
5) WINNER SELECTION/DRAWS. On or before December 8th 2006, a random draw will be conducted by independent judges in Toronto, Ontario, at 1:00 p.m. from all eligible entries received between September 12th, 2006 to December 1st, 2006. This draw will be for one (1) Grand Prize trip for two (2) to see Alexisonfire perform live at a small club in Toronto and twenty (20) secondary prizes of one (1) Alexisonfire limited edition Maxell USB Flash Drive. In order to win, the selected entrant must first correctly answer a time-limited, mathematical, skill-testing question without assistance or mechanical or electronic aid. All decisions of the independent contest judging organization are final.
6) WINNER NOTIFICATION. Winners will be notified by telephone and/or email the week following the draw. Grand Prize Winner will be required to complete and execute a standard Winner’s Release Form confirming compliance with these Rules and acceptance of the prize as awarded. Failure to return all required documents within 7 days will result in the winner being disqualified and an alternate winner selected.
7) PERSONAL INFORMATION. Information gathered from the online entry form is for the sole use of Sponsor in connection with the Contest. Personal Information (your name, address, telephone number and email) will not be passed on to any other organization or group for the purpose of solicitation. No correspondence will be entered into except with the selected winners who will be notified by email or telephone. By entering the contest, each entrant consent to the use of their name, address (city and province only), likeness (photograph) and statements in any publicity carried out by Sponsor without compensation or limitation, and may be required to execute affidavits of eligibility and/or a publicity release.
8.) Sponsor reserves the right to terminate or modify the Contest in any way that it deems to be fair and equitable in the event of an occurrence which may materially affect the proper play of the Contest. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
9.) Subject to paragraph 8, if for any reason this Contest is not capable of running as planned, or if this Contest or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor's sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Contest or any portion thereof. If such cancellation, termination, modification or suspension occurs, notification will be posted on the Website. Any attempt by any person to deliberately damage any web site or undermine legitimate operation of the program is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to disqualify and seek damages from any such individual to the fullest extent permitted by law. In the event of dispute over source of any electronic entry, the entry will be attributed to the authorized account holder of the email account. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.
10) By entering the Contest, each entrant agrees to abide by these Official Contest Rules and Regulations, which are subject to change without notice to Contest entrants individually, and each entrant releases the Contest Sponsors, their respective parents, affiliates, subsidiaries, directors, officers, employees, representatives, agents, advertising and promotional agencies and prize suppliers, from any damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest or the use of any prize
11) No substitution for, or transfer of, or cash equivalent, of prizes will be allowed. The chances of being selected depend upon the total number of entries received. The contest is subject to all applicable Federal, Provincial and Municipal laws.
